Welcome to Fitventry. By accessing our website or mobile application, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Fitventry ("we," "us," or "our") operates a platform that connects fitness creators ("Creators") with users ("Participants") for fitness challenges. We act as an intermediary platform and do not employ Creators directly.

1. Health & Safety Disclaimer

• You should consult your physician or other health care practitioner before starting this or any other exercise program.
• By participating in any challenge, you acknowledge that you are doing so at your own risk.
• You voluntarily assume all risk of injury, illness, or death that may result from your participation.
• You agree to release and discharge Fitventry and the Challenge Creator from any and all claims or causes of action, known or unknown, arising out of your participation.

2. Terms for Creators

If you create and publish challenges on Fitventry, you agree to the following:

2.1 Content Ownership & License

You retain full ownership of the videos, text, and images you upload ("Your Content"). However, to operate the platform, you grant Fitventry a **worldwide, non-exclusive, royalty-free, transferable license** to host, store, cache, reproduce, distribute, and display Your Content.

2.2 Music & Copyright

You represent and warrant that you own or have obtained all necessary licenses for any content you upload, including **background music**. Fitventry strictly prohibits the use of unlicensed copyrighted music. We reserve the right to mute or remove content upon receipt of a copyright claim (DMCA notice) without refunding fees.

2.3 No False Claims

You agree not to make false or misleading health claims (e.g., promising to "cure" diseases). You are responsible for ensuring your advice is safe and accurate.

3. Payments & Refunds

• Fees: Fitventry charges a service fee on transactions to cover platform costs. This fee is non-refundable.
• Refunds: Because challenges are digital content accessed immediately, we generally do not offer refunds once a challenge has started, unless required by local law or in cases of technical failure.
• Payouts: Creators are paid out according to the schedule defined in their dashboard, subject to payment processor (Paystack/Stripe) terms.

4. Acceptable Use

You agree not to:

• Upload content that is sexually explicit, violent, or promotes hate speech.
• Harass, bully, or intimidate other community members.
• Attempt to reverse engineer the Fitventry application.
• Upload viruses or malicious code.

5. Limitation of Liability

To the maximum extent permitted by law, Fitventry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
